1. INTRODUCTION

1.1 - We run a loyalty programme under the name «My Petit Bateau» which we refer to below as the «Programme». Set out below are the terms and conditions (which we refer to below as the «Rules») which govern the operation of, and your participation in, the Programme. Please read these Rules carefully. By joining the Programme you agree that you have read and will comply with these Rules at all times and will comply with all applicable laws and regulations in the United Kingdom relating to the Programme.

1.2 - When we say «Petit Bateau», «we», «us» and «our» in these Rules we mean Petit Bateau UK Limited (company number 03274758) whose registered address is at Petit Bateau Customer Care, 106-108, Kings Road, London SW3 4TZ.

1.3 - These Rules may be viewed at any time on our website www.petit-bateau.co.uk (which we refer to below as the «Website»).

1.4 - We reserve the right to amend these Rules or end the Programme at any time without prior notice to you in response to any change in applicable laws and regulations, judicial decisions, changes in recommendations or guidance issued by governmental agencies and/or any reasonable changes in our commercial policy.

1.5 - Any amendments we make to these Rules will be posted on the Website. Your continued participation in the Programme after we have posted a change to these Rules on the Website is your acceptance of the change made to these Rules. Should you at any time not accept these Rules or any change we may make to them, you should notify us immediately of your wish to withdraw from the Programme.

1.6 - We reserve the right to remove you from the Programme if at any time we have reasonable grounds to believe that you have breached any of these Rules or any laws and regulations in the United Kingdom applicable to the Programme.


2. JOINING THE PROGRAMME

2.1 - Provided you are over the age of 18 you may join the Programme free of charge when you purchase any of our products in participating stores in the United Kingdom or on the Website.

2.2 - To join the Programme and to receive information about Petit Bateau and special offers and promotions made available only to members of the Programme, you must complete and submit to us the registration form available at www.petit-bateau.co.uk or at participating stores (referred to in these Rules as the «Registration Form»). You must complete all fields marked as mandatory on the Registration Form in order to join the Programme including your full name and e-mail address or mobile number. You will also be asked (but not required) to provide us with the following information:
(a) your postal address
(b) your date of birth
(c) the names and date of birth of your children (if any).

2.3 - The information provided by you in your Registration Form must be accurate, complete and true. We reserve the right to verify by any means that we deem appropriate any information that you provide to us.

2.4 - If we accept your Registration Form and your participation in the Programme we will provide you with a subscription number. This subscription number will appear on any message you receive from us in relation to the Programme and on all receipts or invoices following a purchase in a participating store or via the Website. We will also tell you your subscription number on request in any participating store. No physical loyalty card shall be issued in the event that you decide to join the Programme.

2.5 - You may only join the Programme once and you may not use multiple names, mobile numbers or e-mail addresses to join the Programme or register anyone other than yourself to join the Programme. You may not join similar loyalty programmes run by us in other countries if you join the Programme in the UK.

2.6 - Any individual, who already has a Petit Bateau loyalty card, prior to the commencement of the Programme, will automatically be registered under the Programme and shall keep the same subscription number. Further to the implementation of the Programme, the existing points balance on the card shall automatically be transferred as follows:
(a) Each point shall be multiplied by three (3) given that under the current rules of the current Petit Bateau loyalty card, £3 = 1 point whereas under the Programme rules, £1 = 1 point
(b) The validity of the points which are automatically transferred shall be extended by twelve (12) months.


3. SETTING UP A CUSTOMER ACCOUNT

3.1 - Once you have a subscription number you will be able to create a customer account on the Website using the details and instructions provided in a participating store or on the Website.

4. PROGRAMME LEVELS

The Programme is made up of two levels as defined below:

4.1 - LEVEL 1

If you join the Programme when you make a purchase which is less than £40.00 (excluding delivery costs, personalisation and gift wrapping for a purchase on the Website) you shall join level 1 of the Programme.

Level 1 of the Programme means that we will send you by email and/or by text (as chosen by you on the Registration Form) information on special offers reserved to subscribers of level 1 of the Programme.

4.2 - LEVEL 2

If you join the Programme when you make a purchase which is equal to or more than £40.00 (excluding delivery costs, personalisation and gift wrapping for a purchase on the Website) or you make a second purchase (in a participating store or on the Website) or, in accordance with article 5.4, in the twelve (12) months following the purchase which gave you access to level 1, you will join level 2 of the Programme.

Level 2 of the Programme means that we will send you by mail and/or by text (as chosen by you on the Registration Form) information about Petit Bateau and special offers reserved to subscribers of level 2 of the Programme.


5. POINT ACCUMULATION

5.1 - As from the date of joining level 2 (either directly as a result of your initial purchase or following your second purchase within twelve (12) months from joining level 1), you shall also accumulate pointsfrom your purchases.

5.2 - The accumulation of points shall work as set out below and take place at the check-out in the participating stores or on the Website for all purchases:

- £1 = 1 point.

- Length of validity of each point = Points only valid for 12 months as from the date of the purchase which resulted in the gain of the said point.

5.3 - The accumulation of points shall allow you to benefit, subject to the date of validity and article 5.7 below, from the following discounts which must be used in full on your next purchase (as from the next day) as follows:

Please note that the points to be accumulated and/or the discount applied may differ in other countries in which Petit Bateau offers similar loyalty programmes.

5.4 - Subject to article 5.3, you can accumulate points for purchases made in the United Kingdom in branches, in the stores of our UK Partners or on the Website only and for purchases made in other countries in which Petit Bateau offers similar loyalty programmes (in branches, participating Partners and on Petit Bateau websites only) including France, the Benelux countries, Germany and Italy. The accumulation of points from purchases made in Germany will be effective at the same time as in the UK; whereas the accumulation of points from purchases made in Italy will only be effective as from April 2014. You cannot accumulate points for purchases made neither in the United Kingdom, nor in other countries in which Petit Bateau offers similar loyalty programmes, in factory outlets or in department stores concessions (except for the Vienna department store concession in Austria).

Discounts will only be applied to purchases made in the United Kingdom (branches or participating Partners only) or on the Website.

5.5 - You can see the number of points on request in the participating stores, by accessing your customer account on the Website and/or looking at your receipts. Please note that the loyalty discounts are not divisible and can only be used for one purchase.

5.6 - If you return any product in relation to which points have been awarded in accordance with these Rules, those points will be automatically deducted at the time of return.

5.7 - The loyalty discount cannot be used in conjunction with the purchase of gift cards. The loyalty discount cannot be applied to the purchase of shoes (on sale or otherwise); however, it can be used in conjunction with any other promotional offer.


6. USE OF YOUR PERSONAL INFORMATION

6.1 - Any information about yourself that you provide in connection with the Programme will be used by us for the purpose of running the Programme as described in these Rules and always in accordance with our privacy policy available at www.petit-bateau.co.uk/privacy-policy/

6.2 - As part of the registration process for the Programme, you agree to receive e-mails and SMS from us, our affiliates and our partners concerning our news and products, services and offers which we believe may be of interest to you. You may at any time notify us that you no longer want to receive these e-mails either by following the instructions set out in the e-mails themselves or as set out in our privacy policy (see rule 6.1 above).

6.3 To the fullest extent permitted by law, Petit Bateau shall have no liability or responsibility to you in respect of your entry and participation in the Programme. However, we are responsible for any loss or damage you may suffer that is an obvious consequence of our breach of these Rules or our negligence. Except for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, fraud and fraudulent misrepresentation and any other liability which cannot be excluded or limited by law (in which case our liability is unlimited) our liability to you arising out of or in connection with the Programme and/or these Rules shall not exceed £500.

Participation in the Programme implies knowledge and acceptance of (i) the characteristics and limitations of the Internet; (ii) the absence of protection of data against possible misappropriation or pirating; and (iii) the risks of contamination by possible viruses and bugs. Accordingly, Petit Bateau shall have no liability to you, directly or indirectly, in respect of any incorrect usage, appropriation or other incidents related to the use of a computer, Internet access, maintenance or malfunction of the Website, telephone lines or any other technical connection, and the sending of entry forms to an incorrect or incomplete address.

We shall not be held responsible or liable to you if, for any reason beyond our reasonable control or where justifiably necessary, we have to cancel or suspend the Programme or alter these Rules.


7. GENERAL

7.1 - You acknowledge and agree that these Rules set out your entire understanding of the operation of the Programme by us. No information of any nature about the Programme wherever found should be relied upon unless set out in these Rules or any documents incorporated by reference into these Rules.

7.2 - In the event that any rule or part of any rule is held to be illegal, invalid, void or otherwise unenforceable it shall be removed from these Rules which, other than for the rule or part of the rule removed, shall continue in full force and effect.

7.3 - No delay or failure by us in exercising or enforcing any right or remedy provided under these Rules or by law will be deemed to be a waiver of the right or remedy, nor will that delay or failure operate to bar the exercise or enforcement of such right or remedy at any future time.

7.4 - No third party shall have any rights under or in connection with these Rules by virtue of the Contracts (Rights of Third Parties) Act 1999.

7.5 - In the event of a dispute you must notify us by way of a letter sent by registered or recorded post to 2nd Floor Radiant House, 36-38 Mortimer Street, London, W1W 7RG.

7.6 - These Rules and any dispute or claim arising out of or in connection with these Rules, their subject matter or formation and/or the Programme (including without limitation any non-contractual dispute or claim) are governed by English law and any dispute or claim arising out of or in connection with these Rules, their subject matter or formation and/or the Programme (including without limitation any non-contractual dispute or claim) will be subject to the exclusive jurisdiction of the English courts.
